TachoPro Terms of Use
These Terms of Use govern your use of TachoPro ("TachoPro", "the app"), provided by KodKite. By using the app, you agree to these terms.
1. Driver Assistance Only
TachoPro provides reminders, estimates, warnings, documentation support, export tools, country timeline information, and cabotage planning support. All app output is informational only. Warnings and calculations may be wrong if GPS, device time, permissions, settings, manual entries, country detection, app availability, or legal assumptions are incorrect.
2. Your Responsibilities
- You are responsible for complying with all applicable driving-time, rest-time, working-time, cabotage, road-safety, and recordkeeping laws.
- You are responsible for maintaining legally required tachograph records, transport documents, cabotage documents, CMR or equivalent documents, and employer records.
- You must verify any app guidance before relying on it, including PDF/CSV exports and cabotage counters.
- You must not use the app while driving or whenever it is unsafe or unlawful to interact with your device.
3. No Official Recording Function
TachoPro does not replace a tachograph or any other legally required recording system. App logs, correction records, PDF exports, CSV exports, country timelines, and cabotage reports are not official regulatory records. Official tachograph records and other legally required records remain the source of truth for compliance checks.
4. GPS, Country Detection, and Cabotage
GPS and country detection are provided as convenience features. They may be delayed, unavailable, or inaccurate, especially near borders, indoors, during poor signal conditions, or when device permissions or battery settings interfere. Cabotage features are manual planning aids for tracking declared cabotage periods and operations; they do not automatically determine legal eligibility and do not guarantee compliance with Regulation (EC) No 1072/2009 or local rules.
5. Exports and Sharing
TachoPro can generate PDF and CSV exports. You are responsible for reviewing exported files before sharing them with an employer, dispatcher, authority, adviser, or any third party. Exported files may contain activity timelines, corrections, country timeline entries, cabotage entries, notes, timestamps, and other information recorded in the app.
6. Pro Features, Trials, and Subscriptions
Some TachoPro features require an active Pro subscription or other active Pro entitlement. At the time of writing, Pro is required to start new shifts, export PDF or CSV reports, use the cabotage assistant, log ferry and train rest interruptions (Art. 9), enable voice alerts, and control the data retention period. The set of Pro-gated features may change with app updates.
A free trial may be available for eligible new subscribers where offered by Apple App Store or Google Play. Subscriptions renew automatically unless cancelled through your Apple App Store or Google Play account before the renewal deadline shown by the store. Prices, trial availability, taxes, billing period, renewal terms, cancellation rules, and refund handling are controlled by the store and may vary by country.
TachoPro may cache your last successful Pro entitlement check for an offline grace period of up to 7 days so paid features can continue briefly when the device is offline. If a shift was already in progress when a Pro entitlement expires, tracking for that shift can continue until the shift is ended. Existing local logs can remain viewable without an active Pro entitlement, but starting new shifts, making corrections, exporting, or using other Pro features requires active access.
7. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for lawful personal or professional use, subject to these terms.
8. Prohibited Use
- Do not use the app to falsify records, transport documents, tachograph records, cabotage evidence, or other evidence.
- Do not use the app to interfere with tachographs, employer systems, official records, or enforcement checks.
- Do not reverse engineer, misuse, overload, or attempt to compromise the app.
- Do not use the app in a way that violates applicable law or creates unsafe driving behavior.
9. Availability and Updates
We may update, change, suspend, or discontinue app features. We do not guarantee that the app will always be available, uninterrupted, accurate, or compatible with every device, operating-system version, vehicle, employer process, or legal scenario.
10. No Warranties
The app is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we disclaim warranties of accuracy, availability, merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, KodKite is not liable for fines, penalties, enforcement actions, loss of income, business interruption, data loss, device issues, incorrect exports, incorrect warnings, missed warnings, or other damages arising from use of, inability to use, or reliance on the app.

13. Changes to These Terms
We may update these terms from time to time. Updated versions will be published on this page with a revised "Last updated" date. For significant changes, we will take reasonable steps to inform you through the app. Where required by applicable law, we will seek your active re-acceptance of material changes within the app.

15. Governing Law
These terms are governed by the laws of Germany. Nothing in these terms limits your rights under mandatory consumer protection laws applicable in your country of residence.
